1. Services
The Fraport AG travel agency (hereinafter called "TS" for Travel Service) acts as agent for external services in the form of travel services (for ex. flights), other services (for ex. hotel bookings, rental cars) and package tours organized by external companies (for ex. TUI, Neckermann). Therefore, the following terms apply exclusively to the arrangement of external travel services and other external tourist services.

For the reservation of package tours (e.g. through TUI4U) and reservations of rental cars (Sunny
Cars) on www.frankfurt-airport.com, TS is only the provider of the marketing platform. For such
reservations there is no contractual relation with TS. The General Terms and Conditions of the agents and external companies are valid.

2. Agency agreement
The offers made by TS do NOT represent a binding offer by TS or by the respective service provider.

By entering personal information and by sending the online booking form or by making a booking
made in writing, on telephone or by telefax, the customer delivers a binding request that he/she would like TS to provide a travel-related or other tourist service. The customer is bound by the request for 2 full working days starting from the day (Sunday evening excluded) the booking was made.

TS verifies the request and sends the customer an acceptance or rejection or submits a new offer,
which the customer can accept within the specified time limit. The agency contract becomes binding for TS as soon as the customer receives the booking confirmation and travel fare. The acceptance of the request for organization by TS can be made in writing, by telefax or via online services. Any confirmations of receipt (i.e. the simple confirmation that TS has received the request) made by TS do not represent an acceptance of the offer.

After accepting the agency contract from TS, the relevant terms of the organizer and the present terms shall apply for cancellations and alterations to a booking order in accordance with No.5. By registering other travelers, the customer undertakes responsibility for their contractual paragraphs (particularly for the payment of travel charges). The contractual stipulations and the "General Terms and Conditions" listed here apply to all passengers. The contract is subject to German Law regardless of the nationality and the resident country of the customer.

Through the contract, TS undertakes to organize the booked travel and other tourist services
according to the rules. The supply of the booked services as such is not a part of TS's obligations. In the relationship between the customer and the provider, the terms agreed between the two shall be exclusively applied. The appropriate General Terms and Conditions of the provider shall be referred to in this respect.

3. Payment / Travel documents
For all tours and services arranged by the TS, payments must be made before the start of journey,
latest at the time of receiving the travel documents. The documents cannot be dispatched or handed over without payment of the travel fare. The amount to be paid and the due date are specified separately on the booking confirmation. The cancellation, alteration and processing charges specified on the booking confirmation are payable immediately.

The payment can be made via credit card, bank transfer, direct debit or in cash. The travel fare is
payable immediately.

After payment of the travel fare, the air tickets and travel documents shall be sent to the customer on request or be kept for the customer to be picked up later from TS.

4. Liability of TS as agent
All information about the organized travel or tourist services are based exclusively on the information provided by the tour organizer, the service provider or the travel services provider. In particular, they do not represent any quality statement by the TS vis-à-vis the traveler. With regard to the arranged services, the TS is liable only for the proper arrangement of the tour service and provision of information about the service supplier to the passenger, however not for the provision of services through external service suppliers or travel companies. TS is not liable for the availability of a travel service at the time of the booking. This shall not apply as far as TS was aware of incorrect information or had to exercise the customary care during application. In this respect, the liability of TS for the imputed knowledge of such circumstances is however restricted to willful and gross negligence.

TS points out that the terms and conditions of the tour organizer and the travel services provider
substantiate special obligations of the customer. Travelers must particularly note details such as
check-in time and other functions specified in the air ticket.

The customer must immediately point out any shortcomings in the agency service to TS. The TS must be given the opportunity to rectify such failings. As long as such failings did not occur culpable, although reasonable corrective actions would have been possible by TS, any kind of claims by the customer from the agency contract shall not be applicable.

TS is not liable for the loss, destruction or damage of the travel documents during dispatch.

The contractual liability of TS is restricted to willful and gross negligence except for any violation of the main service obligations, absence of quality-related information, as well as injuries to life, body or health. In case of slight negligence, the contractual liability of TS for damages not based on life, body or health injuries, is limited to triple the value of the tour and to typical and predictable damages.

5. Changes / Cancellations
An organized service can be altered only by first canceling it and then making a new booking, as long as the service supplier has no special rules to the contrary. In the case of cancellations and
alterations, TS can claim compensation for incurred expenses and hiring charges in accordance to the details in the booking confirmation. In case of a fresh booking, as long as TS or the service provider are responsible for the alteration, the TS is entitled to a new compensation of costs and commissions.

6. Special fares and charter flights
Special fares and charter flights are possible through flights arranged by TS at special terms and
special rates. The present special terms apply here:

a) Only the airlines mentioned in the flight documents are enlisted. Alterations and changes are
possible only through TS.

b) As long as it is demanded, the passenger must reconfirm all to and from flights and other flights
latest 72 hours before departure, otherwise all claims for travel shall be dropped.

c) Any refund for air tickets that are not fully used is not possible.

d) For cancellation of flights with special fares or charter flights, as in all organized tour services, the revocation terms of the airline, the service provider or organizer shall be applied. The cancellation costs can be up to 100% of the tour fare. TS can be entitled to the ensuing cancellation charges of 30 Euros for processing the booking and the subsequent cancellation as well as for any incurred hire charges. The service fee is non-refundable. All cancellation flat rates apply per person or per air ticket. The passenger is at liberty to show proof of minimum damage or no damage vis-à-vis the service supplier.

e) We would like to point out that we only act as agents for Airlines and Charter flight Companies and do not provide the actual services. The liability of the airline is based on its applicable terms and conditions that are mentioned in the travel documents of the concerned company handed over to you at the time of booking.

7. Tariff and fare changes
The TS reserves the right to increase the advertised and confirmed airfare in case of increase in travel costs or taxes for specific services (airport charges,...) on behalf of the airline to the extent that will affect the tour fare per person and per seat. The fare hike increase is permitted only 21 days before the stipulated start of journey. At the same time, there must be a period of more than 4 months between the conclusion of the agreement and the start of the journey. TS undertakes to notify the customer of any fare hike immediately, and on request, to explain the reasons and the extent of the fare hike. If the fare hike is more than 5%, the customer is entitled to cancel the booking without paying cancellation charges. The cancellation must be made immediately.

8. Service changes
Alterations and changes are only permitted as long as they are not considerable and do not alter the full character of the tour. However, TS and the provider have the right to substitute some hotels with hotels from the same category or more expensive ones, to switch Airlines or aircrafts or to alter routes. The passenger must be duly informed about such changes as soon as possible.

9. Terms and conditions for passport, visa, customs, foreign exchange and health
The information provided by TS from the present systems (Start Amadeus) about the terms and
conditions for passport, visa, customs, foreign exchange and health refer only to travelers with
German nationality. On request TS shall provide information on these points conscientiously.
Nationals of other countries are requested to procure information for all destination and transit
countries from the respective Consulate. In addition, the details of the tour organizer must be
observed.

The traveler is solely responsible for adhering to all important regulations for the implementation of the trip / flight. The customer is exclusively liable for any costs and disadvantages ensuing from noncompliance of such stipulations.

10. Acknowledgement
On finalizing a booking with the TS, the passenger acknowledges the above mentioned travel terms and conditions. All individual arrangements must be made in writing, verbal arrangements are invalid.

11. Invalidity of travel terms
The invalidity of any specific terms of the travel agreement and of these business terms and conditions does not imply the complete invalidity of all the terms and conditions.

12. Jurisdiction
Place of jurisdiction is Frankfurt am Main, Head Office of the Company.
