Participation and Organization Conditions
Participation in the “Sun or Snow?” online contest on the Iconosquare internet platform or via Fraport's respective social media channels on Facebook, Twitter and Instagram or their organization shall be bound by the following terms and conditions: Unlike TV contests, the participation in online contests is possible only online.

§1 Organizer/Action

1.1
The organizer of this campaign is Fraport AG Frankfurt Airport Services Worldwide headquartered at Frankfurt am Main (hereinafter referred to as “Fraport”).

1.2
The subject of this campaign is a prize draw to win a voucher entitling the winner to a dinner for two persons at the Sheraton Frankfurt Airport Hotel & Conference Center in their restaurant “Flavors” as well as an overnight stay in the Deluxe Room Plus with a view to the airport. For that purpose, Fraport shall offer participation in the contest via the social media channels mentioned above during the period from December 21, 2015 up to January 31, 2016 at 11.59 PM.

§2 Participation

2.1
Participation shall be restricted to natural persons of full age. Employees of Fraport and their family members shall be excluded from participation in the raffle.

2.2
To be eligible for participation in this campaign, a photograph meeting the requirements of the Contest must be submitted via Iconosquare, Instagram, Twitter or the Facebook Contest App. Besides, this photograph must be hashtagged #FRAmoments. By uploading such photograph, the user permits Fraport to use this photograph in accordance with paragraph 3 mentioned below.

2.3

To participate in the campaign, truthful information on the person as well as  the corresponding account details of the third-party service provider (Iconosquare, Facebook, Instagram, Twitter) are required.

For the avoidance of doubt, it is expressly stated that the recipient of the data provided is Fraport.

2.4
By uploading the photograph referred to in item 2.2 to one of Fraport's platforms, the respondent accepts the present Conditions of Participation and Organization in his or her own name and in representation of the persons shown in the uploaded photograph and his or her travel companion should this person be different from the one pictured in the photograph.

2.5
Each participant may participate in the campaign only once. Multiple participations count as one participation.

2.6
Incorrect information or incomplete compliance with the task of the Contest will result in the participant's exclusion from the campaign. The Organizer shall not be held liable for delayed or incomplete submittals.

2.7
By participating in the Contest, the Participant warrants that neither he or she nor the person nominated suffers from any hindering or aggravating factors that may impede their making the trip on the account of health reasons or any other issues in the event of their winning, and that the trip will be made at their own risk.

§3 Transfer of Rights

3.1
Fraport shall be entitled to make the photographs submitted by the Participants for the FRAmoments campaign available on the Frankfurt Airport Facebook page, on the  @Airport_FRA Twitter account, on the Frankfurt Airport Instagram account under the #FRAmoments, #welcome, #goodbye, #travel, #fascination, #love, #feelgood and #happy hashtags and in Fraport's newsletter, on stand-up displays at Lufthansa AG's check-in counter, in the “Startfrei” print magazine, as well as online in the startfrei-online, frankfurt-aiport.de and lufthansa.de domains and in the frankfurt-airport.de social hub.

3.2
The Participant undertakes to obtain any rights concerning the author of the photograph and the personal rights of the individuals shown, thus making sure that there are no gaps in the chain of title, and shall give evidence thereof upon request. The Participant hereby holds Fraport harmless of any and all third-party claims in connection with the photograph uploaded.

3.3
The transfer of rights will be granted for the duration of the legal protection periods, without any geographic restrictions or limitations in terms of content. It extends to all affected legal positions of the contracting parties, in particular to copyright, intellectual property rights and personality rights.

3.4
Fraport shall be entitled to pass the rights of use on to the Sheraton Frankfurt Airport Hotel & Conference Center.

3.5
By accepting the prize, the Participant and his or her accompanying person agree that they will take part in the production of series of photos and/or video documentation about the prize. The Participant consents without any restriction or time limit whatsoever to publication in all communication channels, especially in the social media channels of Fraport and of Sheraton Frankfurt Airport Hotel & Conference Center, in connection with the Contest, and also to PR activities for Fraport and Sheraton Frankfurt Airport Hotel & Conference Center.  In addition, the Participant accepts that besides the prize no other consideration is due. This is especially true for cash payments.  Appropriate permissions for the cooperation and for the use of text, picture and video material of the Participant, including his or her travel companion, are a prerequisite for the allocation of the prize and will be obtained in writing

§4 Period and Prize

4.1
The campaign shall be launched on December 21, 2015 and ends on January 31, 2016 at 11.59 PM. The deadline for uploading the photograph is December 31, 2016 at 11.59 PM. The reception time recorded by Fraport shall apply.

4.2
Prize: A dinner and an overnight stay in the Sheraton Frankfurt Airport Hotel & Conference Center will be raffled off for two persons.

  • The prize: One dinner in the restaurant “Flavors” and one overnight stay in the Deluxe Room Plus with a view to the airport; both offers being valid for two persons.
  • The appropriate reservation conditions and tariff provisions at the time of the reservation shall apply. Restrictions may arise. Exclusion days shall apply and the rooms shall depend on their availability. Preferred dates can only be complied with if available at the time of reservation.
  • There is no entitlement for any further benefits not mentioned in the description of the prize. Cost coverage for access to and return from the hotel, as well mobility at the destination and all personal expenses are expressly excluded.
  • The prize must be redeemed by July 31, 2016.
  • Once a travel date has been reserved, it can no be changed.
  • The accommodation conditions of Sheraton Frankfurt Airport Hotel & Conference Center shall apply.
  • The prize cannot be paid in cash.
  • The validity of the prize cannot be extended.
  • The winners must redeem both vouchers together, at the same time.
  • The reservation confirmation will be emailed upon confirmation of the wish to travel.
  • The vouchers relate exclusively to the redemption of the prize at the Sheraton Frankfurt Airport Hotel & Conference Center at Frankfurt Airport
  • The vouchers can be issued in the name of the winner and his or her travel companion only.

4.3
Entitlement to the prize cannot be transferred or assigned. Should it not be possible to make the prize available, for any reason whatsoever, the Organizer reserves the right to grant an equivalent substitute prize. Cash payment of the prize is not possible.

The organization of the Contest, as described under item 1.2, shall be the responsibility of Sheraton Frankfurt Airport Hotel & Conference Center. Fraport acts only as an agent and intermediary. In particular, Fraport shall not be responsible for any changes of the room category or any other circumstances falling within the competence of the operator (hotel).

4.5
An internal jury of Fraport AG and Sheraton Frankfurt Airport Hotel & Conference Center shall determine the winner among all participants. The winner will be notified by direct message sent to the participating account of the relevant platform. After receiving notification of the prize, the winner must confirm receipt of notification and acceptance of the prize within two weeks using the contact methods mentioned in the notification of the prize. Otherwise the prize will be assigned to another participant.

4.6
The prize shall also be forfeited if allocation cannot be made within two weeks upon confirmation of the entitlement to the prize due to reasons that are attributable to the winner himself or herself.

4.7
Any questions, comments or complaints regarding the Contest shall be addressed directly to Fraport. None of the social media channels used shall be liable for the organization of this Contest. Fraport is not responsible for the technical reachability or feasibility of Competition.

§5 Exclusion from Participation

The Organizer reserves the right to exclude certain participants should they infringe these Conditions of Participation.

5.2
Furthermore, the Organizer reserves the right to exclude any participant who makes use of any illegitimate means or manipulates the Contest in any other way to obtain advantages (such as collective or multiple participations). Such prohibited means are automated scripts. hacker tools, Troyans or viruses or any other intents to seek advantages.

§ 6 Premature Termination or Abandonment of the Contest

The Organizer shall be entitled to break the campaign off prematurely, to suspend or to prolong it, if unforeseeable obstacles that are outside the Organizer's sphere of influence occur, these obstacles aggravating or making the execution of the event unreasonable for the Organizer. Such circumstances include in particular, yet not exhaustingly: any non permitted intervention by third parties, technical hardware or software issues lying outside the field of power of the Organizer as well as violations of law in an direct connection with the organization of the campaign, especially any manipulative intervention into the process of the Contest. In any such case, Fraport's liability shall be excluded to the extent legally possible. There is no entitlement to registration for the campaign or participation in the Contest.

§ 7 Data Protection

Privacy Policy

By participating in this Contest, the participant agrees that his or her data shall be stored for the duration of the Contest and used for the Contest and its handling. Fraport shall not make available the data to third parties; yet Fraport cannot exclude any possible use by Facebook, Twitter, Instagram and Iconosquare. In all other respects the provisions of the Federal Data Protection Act shall apply.

§ 8 Final Clauses

8.1
Recourse to the courts shall not be permitted.

8.2
The law of the Federal Republic of Germany shall apply.

8.3
In the event that any individual provisions should be or become invalid, this shall not affect the validity of the remaining provisions.
